Terms and Conditions

Indian Academic Championship (INDAC)

By using this website, you are accepting the following terms and conditions.

  1. The Indian Academic championship (INDAC) (the “Competition”) is a competition organised by Xpress Minds Edutainment (P) Ltd. ("XM”), to identify the most knowledgeable school students in India. XM is hereinafter referred to as the “Organizers”.
  2. The competition is being conducted in association with International Academic Competitions (USA) promoted by David Madden. International Academic Competitions (USA) has been conducting several globally renowned competitions at USA, Asia, Europe and World level since 2010.
  3. Participation in INDAC is the ONLY method of participating in International Academic Competitions events for students living and studying in schools in India.
  4. The Competition is open to all students of classes/grades 4-9 from all schools in India.
  5. The Online Regional Qualifying Examination (ORQE) is open to all students without payment of any fee. All students registering for the ORQE are referred to as participants.
  6. The regional round of the Competition is open only to such participants who have successfully paid the requisite fee.
  7. By participating in the Competition, each Participant acknowledges and agrees to the terms and conditions contained herein and all related terms and conditions governing the Competition.
  8. The Competition shall be held between January 2025 and May 2025, and will be in 2 phases which consists of:
    1. Online round (ORQE) to be held on: All registered participants can take the online mock tests followed by an ORQE comprising 50 questions.
    2. Regional Round: The top 50% students OR students scoring over 50% in the ORQE – whichever is higher – will be eligible to participate in the on-ground regional round which will be held at multiple locations in India.
  9. The winners/runners up shall not have any right to claim any kind of alternative i.e., either in cash or in kind, in in lieu of the awards/prizes mentioned herein.
  10. The guardian and the Participant agree that only the winners of each phase will proceed to the next round and the decision of Judges/ Organizers in this matter shall be final and binding. The Participants, their guardians and/or the school hereby accept and agree that mere registration of the Participants shall not entitle or make such Participant eligible for any further rounds of the Competition or to any prizes.
  11. Using of false names/ identities, illegal/false mobile numbers, fake email addresses and/or any other illegal means either online or in hard copies shall be considered as suppression of facts entailing immediate disqualification. In the event XM suffers any adverse consequence because of the same, the Participant(s) shall be penalized for the same in a manner as XM may deem fit.
  12. Participants found indulging in any malpractices such as cheating, misrepresentation, providing false information shall be disqualified from the Competition with immediate effect and strict legal action may be taken by XM against such Participant(s).
  13. The Participant shall not behave in unruly manner and shall always maintain decorum during the activities relating to the Competition including without limitation shooting of the Competition. The Participant undertakes to not do any act in violation of any applicable law or not make any obscene, vulgar gesture(s)/acts, or any defamatory statement against any event and/or persons and/or any section of society and/or religious or political group including without limitation any person alive or deceased or do any act during the Competition that will expose XM and its affiliates to any civil and/or criminal proceedings or any claims from any third party/parties. Further, the Participant undertakes not to make any statement or do any act which would be construed as a statement made/act done for advertising/promoting any product or thing or person or any section of society or religious group or political group.
  14. The Participant shall be solely and exclusively responsible for the Participant's own actions including without limitation the words, views, opinions, and statements expressed during the Participant’s participation in the Competition and/ or for any related activity/activities.
  15. The Organizers shall not be responsible and/or liable, in any manner, for any Participant’s failure to participate in the Competition or register for the Competition on account of any failure on the part of the telecom operator, internet service provider or facility provider or for any other similar reason.
  16. The Organizers may use the information collected from the Participants/their guardians or the schools for the purposes of verifying the accuracy/correctness of the information provided, including verifying the Participants’ eligibility. The Participants, their guardians and/or the school hereby accept and agree that the Organizers may retain such information after conclusion of the Competition. The Participants, their guardians and/or the school further accepts and agrees that the Organizers shall not be liable or responsible for any loss or damage arising on account of any disclosure of such information.
  17. XM takes appropriate technical and organizational measures to protect the personal information provided by the Participant against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure, or access. However, XM cannot guarantee the security of any personal information or data which the Participant discloses. In any event, Participant agrees not to hold XM responsible for any breach of security, except in case of negligence or willful default on the part of XM under the relevant legislation.
  18. The Participant agrees and acknowledges that he/she is aware that personal information collected by Company will also be used for purpose of the Competition and/or to inform Participant of any upcoming contest(s), campaign(s), survey(s), poll(s), etc., conducted on behalf of the do. The Participant confirms that he/she is consenting to the Organizers retaining and using the Participants’ personal information for above purposes and if at any time the Participant does not want the Organizers to retain and/or use the Participants’ personal information, the guardian or the Participant shall send a written communication to the Organizers to delete and destroy the personal information from date of such communication.
  19. The guardian and the Participant undertake to ensure that they shall not reveal or make public any information, and/or speak/interact with any member of the press in connection with the Competition, including but not limited to the concept or format of the Competition.
  20. In lieu of the opportunity given by the Organizers to the Participant to participate in the Competition, the guardian and the Participant unconditionally and irrevocably consents, to XM, filming and recording the Competition including the Participants participation in the same.
  21. Further the guardian agrees and assures XM that the Participant shall be available for the purpose of marketing and promotional activities including any ground events, if so desired by XM.
  22. The guardian and the Participant further agree to sign all additional documents as may be required by the Organizers in respect of matters concerning the participation of the Participant in the Competition, including a separate agreement to be signed with any of the Organizers, which shall be provided to the Participant.
  23. The guardian and the Participant shall be liable to make true and correct disclosures regarding self and shall inform the Organizers in advance of any special requirement of the Participant, either from medical perspective or otherwise, which the guardian and the Participant is aware of, and which may have a bearing on Participant’s participation in the Competition.
  24. The guardian and the Participant are solely responsible for his/her health and well-being before and during the entire term of the Competition.
  25. The guardian and the Participant acknowledge that he/she have been informed of the format of the Competition and the nature of participation required from the Participant and that the Organizers shall not be, in any manner, responsible to the guardian and / or the Participant for any mishap, injury, accident during the Competition and the guardian and / or Participant shall have no claims against the Organizers towards any loss, claims, damages arising from the same.
  26. The guardian and the Participant agree that the Organizers are not liable to the guardian and/or the Participant for any claim or loss in the event that the Competition is discontinued or cancelled for any reason whatsoever.
  27. The guardian and the Participant further agree to undertake social media activities related to the Competition including writing and posting blogs, photographs, audio visuals (“Post”) as and when specified by XM, as per its requirements. However, it is clarified that any content generated by the guardian and/or the Participant, as per XM’s requirements, including but not limited to any blogs, text, images, pictures, audio, audio visuals etc. in relation to the Competition shall be considered as work-for-hire content generated by the guardian/Participant, and XM shall be the first and only true owner of such content for worldwide exploitation, for perpetuity, on any mode, medium, format whether in existence now and which may come into existence in the future. The guardian/Participant hereby assigns to XM the perpetual, worldwide right in the Post and to use the Post, the name, images, voice, likeness, performance and biographical information of the Participant in connection with the Competition, or otherwise and also for the purpose of promoting the Competition on any mode, medium, format whether in existence now and which may come into existence in the future, without any payment (in cash, kind of otherwise) to be made to the Participant.
  28. The guardian and the Participant hereby allow the use of and shall make himself/herself available for the use of his/her face, name, voice, likeness, photograph, gesture, acts, actions to appear on and be used in connection with the promotion of the Competition in all media including, but not limited to television, radio, press, internet, mobile etc.
  29. The guardian acknowledges that the Participant has on his/her own free will and accord and without any force, monetary or other inducement, coercion or duress participated in the Competition. Further, the guardian and the Participant acknowledges and accepts that all intellectual property rights including Performer’s Rights in and to the Competition are and shall remain the exclusive property of XM from the moment they arise for the entire period of their subsistence, in every part of the world, and XM has the exclusive right to exploit the same, in its sole discretion, worldwide, for perpetuity, on any mode, medium, format whether in existence now and which may come into existence in the future, without any payment (in cash, kind of otherwise) to be made to the Participant.
  30. Waiver of “Moral Rights”: By this Agreement, the guardian and/or Participant acknowledges that he/ she has no claim in any/ all rights related to the Competition.
  31. The guardian and the Participant expressly agree that all rights, title and interest including any and all copyright, intellectual property rights and all other allied, ancillary and subsidiary rights in any and all media, technology now known or subsequently invented throughout the world in and to the Competition, script, musical works, the title and logo etc., and/or the performances / activities undertaken by the Participant is and shall vest with XM, in perpetuity, without any further consideration being due or payable to the Participant.
  32. The guardian and the Participant agree and warrant to submit such other documents as may be required by XM to enable XM to exploit all the rights under these terms and conditions.
  33. The guardian hereby agrees to indemnify and hold harmless, the Organizers, its group companies, affiliates and subsidiaries and their respective officers, directors and employees, against any loss that may occur to them due to his/her actions or omissions while participating in the Competition, or due to any misrepresentations or concealment of material facts by the guardian and/or the Participants or otherwise due to non-adherence of the present terms and conditions.
  34. The guardians and the Participant agree and understand that the Organizers reserve the right to make modifications or changes to the concept/format of the Competition including the selection of winners, judging, the elimination process and the various aspects in relation to the Competition and the Participants shall neither protest nor object to any of the modifications, additions, deletions that shall be made to the concept/format of the Competition and the Participants shall continue to participate without any objection or demur.
  35. The guardians and the Participants undertake to keep XM informed of the Participants updated telephone number, address and whereabouts during the Competition.
  36. The guardians and the Participants hereby accept and agree that he/she shall not, under any circumstances, have any rights or claims against XM.
  37. The guardian hereby represents and warrants that he/she is competent and authorized to accept and execute the present terms and conditions on behalf of the Participant.
  38. XM reserves the right to modify the whole or any part of these terms and conditions, at any time, without any prior notice to the guardians and/or the Participants and/or suspend, shorten, modify, extend, or cancel the same without prior notice, without stating any reason, and no claim in this regard shall be entertained.
  39. The invalidity or unenforceability of any part of these terms and conditions shall not prejudice or affect the remaining parts of these terms and conditions to the extent that it is severable.
  40. The Competition shall be governed by and construed in accordance with the laws of India and the courts at Mumbai shall have exclusive jurisdiction over any disputes or differences arising or relating to the Competition.
